Attorneys and in-house employees are not automatically entitled to receive a real estate commission unless they meet the applicable licensing requirements.

Correct Answer: C 

TREC has the authority to suspend or revoke licenses and place licensees on probation for violations. It does not mediate commission disputes or recommend individual licensees to the public. While TREC oversees exam development, the actual testing is conducted by an independent firm.


Question 3 

What type of property listing requires the owner to pay a commission, even if they sell the property themselves?

  • A) Exclusive Agency Listing
  • B) Exclusive Right to Sell Listing
  • C) Net Listing
  • D) Open Listing

Correct Answer: B 

In an Exclusive Right-to-Sell Listing, the broker holds an exclusive right to sell the property and is entitled to a commission regardless of who finds the buyer — including the owner themselves.


Question 4 

If Catherine’s apartment has depreciated at a rate of 2.5% per year for the 7 years she has owned it, what is its current value if the original cost was $190,000?

  • A) $185,250
  • B) $180,500
  • C) $156,750
  • D) $150,000

Correct Answer: C 

Total depreciation = 2.5% × 7 = 17.5%. Depreciation amount = $190,000 × 17.5% = $33,250. Current value = $190,000 − $33,250 = $156,750.


Question 5 

Which of the following statements about zoning is false?

  • A) Zoning is retroactive
  • B) Zoning laws are generally enforced through building permits
  • C) Zoning laws are concerned with protecting property values
  • D) Violations of zoning ordinances may render title unmarketable

Correct Answer: A 

Zoning laws are NOT retroactive. They are forward-looking and regulate future uses of land, not existing ones.
